This page is an honest, accurate description of what this system actually does, written by the team that built it. It is not legal advice, and it has not yet been reviewed by a lawyer — treat it as the correct starting draft for that review, not as a substitute for it.
1. Agreement
These terms govern access to Floxify, operated by Serpex, a sole proprietorship (Udyam UDYAM-GJ-22-0534867). By creating an account or using the product, you agree to them. If you are accepting on behalf of a company, you confirm you have authority to do so.
2. What the service is
Floxify is a B2B sales-intelligence platform: you describe an ideal-customer profile in plain English, and we return ranked companies, licensed business-contact data about decision-makers at those companies, and self-generated signals (technology usage, hiring activity, growth indicators) about why a company may be a timely fit. Data is provided solely for legitimate B2B sales, marketing, and recruiting prospecting (the “Permitted Purpose”).
3. Acceptable use
You agree not to:
- Use any data obtained through Floxify for a purpose other than the Permitted Purpose, including consumer marketing, credit or employment eligibility decisions, harassment, stalking, or any other purpose restricted or prohibited by applicable data-protection or consumer-protection law.
- Send unsolicited communications to individuals in a way that violates applicable law (e.g. CAN-SPAM, TCPA, GDPR/PECR) — compliant use of any contact data you obtain is your responsibility as the sender.
- Scrape, crawl, or use automated means to extract data from Floxify outside the product’s own search and export features.
- Attempt to circumvent any rate limit, export cap, or access control, or share your account credentials with anyone outside your workspace.
- Re-identify, de-anonymise, or attempt to re-identify any data we have anonymised.
4. Data licence and the export limit
Company and business-contact data made available through Floxify is licensed to you for your own internal use under the Permitted Purpose. You may not resell, sublicense, publish, or redistribute any data obtained from Floxify — in whole, in part, or in any exported form — to any third party as a standalone dataset. This restriction exists because the underlying licence from our data supplier permits us to make the data available through our own product and API, but never to permit onward redistribution of the raw dataset itself.
To make that restriction real rather than aspirational, every export from Floxify is capped at 500 rows per export, enforced server-side. This is a hard technical ceiling, not a default you can request past — it exists specifically to make bulk extraction of the licensed dataset infeasible while remaining useful for a tactical export (“these 400 companies for a sales import”). We may adjust the exact figure without notice; the purpose it serves — that an export from Floxify can never substitute for the licensed dataset itself — will not change.
5. No warranty on data accuracy
Company and contact data is sourced from a third-party supplier and from automated signals we generate from public sources; both can be incomplete, outdated, or wrong. Floxify is provided “as is” without warranty of accuracy, completeness, or fitness for a particular purpose. Verify anything business-critical independently before relying on it.
6. Fees
Fees, billing cadence, and plan terms are as set out in your order form, invoice, or the pricing shown at signup. We use flat, predictable pricing rather than usage-based credit metering.
7. Termination
Either party may terminate for convenience with notice as set out in your order form, or immediately if the other party materially breaches these terms (including the acceptable use and redistribution restrictions above) and does not cure within a reasonable period after notice.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to these terms will not exceed the fees you paid us in the twelve months preceding the claim, and neither party is liable for indirect, incidental, or consequential damages.
9. Governing law
These terms are governed by the laws of Surat, Gujarat, India, without regard to conflict-of-laws principles.
This choice of law governs the contract between us. It does not limit any data protection right you hold under the law of your own country. We comply with the GDPR and the CCPA/CPRA in full, and honour the rights they grant — access, correction, deletion, portability, objection, and opt-out of sale or sharing — for every user, wherever you are, regardless of whether the law of your country would otherwise require it of us. Where those rights and this section conflict, those rights win.
10. Changes
We will update the “last updated” date above whenever these terms change, and make reasonable efforts to notify active customers of material changes.
